Agreement to Terms

These Terms of Service (“Terms”) govern your use of the Orchwood website and all related services. By accessing or using our website, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not access the website.

Products and Orders

All products listed on our website are subject to availability. We reserve the right to limit the quantities of any products or services that we offer. Product descriptions, images, and prices are subject to change at any time without prior notice.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.

Prices for our products are subject to change without notice. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of a product.

Payment

We accept major credit cards and other payment methods as displayed at checkout. By providing payment information, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge the total amount to that payment method.

All payments are processed securely through Stripe. Orchwood does not store your full credit card details on our servers.

Shipping and Delivery

We currently ship within the United States. Shipping times and costs are calculated at checkout based on your location and the items in your order. While we make every effort to ship orders promptly, delivery dates are estimates and not guaranteed.

Risk of loss and title for items purchased pass to you upon delivery of the items to the carrier. We are not responsible for any delays caused by the shipping carrier.

Returns and Refunds

Due to the perishable nature of live plants, seeds, and bulbs, we handle returns on a case-by-case basis. If you receive damaged or incorrect items, please contact us within 48 hours of delivery with photos of the issue.

For preserved flowers and non-perishable items, we accept returns within 14 days of delivery provided items are unused and in their original packaging. Shipping costs for returns are the responsibility of the customer unless the return is due to our error.

Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Orchwood or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this site without our express written permission.

Limitation of Liability

In no event shall Orchwood, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the website or any content on it.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Forsyth County, Georgia.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the website following the posting of revised Terms means that you accept and agree to the changes. We encourage you to review these Terms periodically.
